Guardianship
Guardianships are important when a person is unable to make decisions on their own (e.g. “mentally incapable”) and there was no Power of Attorney for Personal Care and/or Property in place prior to the individual being deemed mentally incompetent.
A Guardianship Order gives legal authority to a substitute decision maker to make choices on behalf of the person deemed mentally incapable. There are two categories of Guardians:
1. Guardians of Property make financial decisions on behalf of the mentally incapable adult
2. Guardians of the Person (Personal Care) make personal care decisions on behalf of the mentally incapable adult
